Notice is hereby given that the Stokes County Board of Commissioners will hold a public hearing to consider the conditional rezoning application described below. This notice is provided pursuant to N.C. Gen. Stat. § 160D-601 (published notice) and N.C. Gen. Stat. § 160D-602 (mailed and posted notice). The application has been submitted to the Planning Board for review and comment under N.C. Gen. Stat. § 160D-604, and the Board of Commissioners will adopt the plan-consistency and reasonableness statements required by N.C. Gen. Stat. § 160D-605 when it takes final action on the application.

Purpose

The Board of Commissioners will receive public comment on the application and consider the Planning Board’s review and comment under N.C. Gen. Stat. § 160D-604. This hearing is called as a special meeting separate from the Board’s regularly scheduled meetings. Consistent with the Board’s adopted procedural safeguards for data center rezoning applications, the Board will not deliberate or vote on the application on the night of this hearing; deliberation and a vote, including the statement of consistency with the Stokes County 2035 Vision Plan and the statement addressing the reasonableness of the proposed rezoning required by N.C. Gen. Stat. § 160D-605, will occur at a later meeting when the Board takes final action on the application. The Board may ultimately approve, deny, or approve with modified conditions the requested conditional zoning district.

Statutory notice

This notice is published once a week for two successive calendar weeks, with the first publication not less than 10 nor more than 25 days before the hearing date, as required by N.C. Gen. Stat. § 160D-601(a). Individual mailed notice is being sent by first-class mail to the owners of the subject parcels and to the owners of all abutting parcels of land, and a notice is being posted on the subject property and/or an adjacent public right-of-way, in each case not less than 10 nor more than 25 days before the hearing date, as required by N.C. Gen. Stat. § 160D-602(a) and (c).

Public participation procedures

Consistent with the Board of Commissioners’ adopted 2026 Stokes County Data Center Rezoning Procedural Safeguards, the County will provide the following additional opportunities for public participation in connection with this hearing. These safeguards supplement, but do not replace, the due process already required by state statute and local ordinance. Except to the extent a safeguard is independently required by law, these measures are voluntary and are not legally binding on the County, and any failure to comply with a voluntary safeguard shall not, by itself, affect the validity of any decision made by the Board.

Public notice and access to information

• A public comment submission portal is available online in advance of the hearing.
• Hearing materials will be posted online at least 10 days before the hearing. Materials received after the initial posting will also be posted online, to the extent reasonably possible, and materially revised or newly submitted materials will be identified.
• Hearing materials will also be available for in-person review at the Stokes County Planning and Inspections Department, 1014 Main Street, Danbury, NC 27016, during normal business hours, beginning at least 10 days before the hearing.
• This procedural safeguards document is posted online at the same time as this hearing notice.
• Written comments may be submitted before and during the hearing through the County’s public comment portal at PublicComments@co.stokes.nc.us, and will be included in the public record.
• The hearing will be recorded by video or audio, and recordings, minutes, written comments, submitted materials, and speaker sign-up information will be maintained as part of the public record, consistent with applicable law.

Public comment period and speaker sign-up

• From 5:00 p.m. to 6:00 p.m., the Board will receive presentations from County staff and the Petitioner.
• From 6:00 p.m. to 9:00 p.m., the Board will receive public comment. Members of the public may sign up in advance for a speaking time during one of six thirty-minute blocks within this three-hour public comment period (6:00, 6:30, 7:00, 7:30, 8:00, and 8:30 p.m.). Advance speaker slots are assigned on a first-come, first-served basis.
• Advance speaker sign-up is available online at form.jotform.com/262233745785162.
• Members of the public who do not sign up in advance may sign up on the night of the hearing. Speakers who sign up that night may be heard during unused slots within a thirty-minute block or if scheduled speakers conclude early; the County cannot guarantee that every speaker who signs up that night will be given time to speak.
• Speaker sign-up will remain open until attendees have had a reasonable opportunity to register to speak.
• Each speaker will be given three minutes to speak. This time limit may be adjusted as needed, but the Board will seek to provide equitable time to each speaker.
• Clear and consistent speaking rules will be applied to all participants, and the Board will demonstrate respect for community members and their viewpoints.

Venue and overflow accommodations

• The hearing will be held in the largest reasonably available venue, with consideration to security and technology limitations and requirements.
• If attendance exceeds room capacity, the County will provide overflow accommodations, including audio and video access where feasible. To the extent this hearing is conducted at the Reagan Building (Administration Building), 1014 Main Street, Danbury, the County will make reasonable efforts to provide overflow accommodations in the third-floor conference room.
• Overflow attendees will have the same opportunity to hear the proceedings and participate.
• The venue is ADA accessible. Persons needing auxiliary aids or services to participate should contact the Planning and Inspections Department in advance of the hearing.
